LocalGetaways respects your privacy and will not share or sell your email to anyone without your prior written approval.

It is our goal to deliver relevant information to you about local travel. This anti spam and privacy policy describes how we treat the information we collect when you visit our Web site located at www.localgetaways.com (Website) and/or register for our weekly email newsletter. It also is intended to explain the conditions under which LocalGetaways uses and discloses that information, and your rights in relation to that information.

Changes to this Privacy Policy are discussed at the end of this document. Each time you use the Website the current version of this Privacy Policy will apply. Personal Information

LocalGetaways does not disclose your personal information to any third party without your express written consent, except to a third party as required to help us distribute our email newsletter.

LocalGetaways does not collect any other personally identifying information that you do not provide. We will never share, rent, or sell your personal information, including your email address with any third parties for marketing purposes.

Non Personal Information

Like many website operators, LocalGetaways gathers from users of the Website non personally identifying information of the sort that web browsers, depending on their settings, may make available. That information could include your internet protocol (“IP”) address, operating system and browser type, and the locations of the Web pages that you view before arriving at, while navigating and immediately after leaving the Website.

Web Beacons

A web beacon is an object that is embedded in a web page that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page. LocalGetaways may use web beacons on the Website to count users who have visited particular pages and to deliver co-branded services.

Web beacons are not used to access users’ Personally-Identifying Information; they are a technique LocalGetaways may use to compile aggregated statistics about Website usage. Web beacons collect only a limited set of information including a cookie number, time, and date of a page view, and a description of the page on which the web beacon resides.

Web beacons can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. Third parties are not permitted to use web beacons on the Website.

Use of Website Restricted to United States Residents

The Website is hosted on servers located in the United States of America and is intended for use by United States residents. You may not use this service if you are not a United States resident.

Children

This is a general audience Website and is not intended for children under 18 years of age. LocalGetaways does not knowingly collect personal information from children under 18.

Should a child whom we know to be under 18 years old send personal information to us, we will use that information only to respond directly to that child to inform him or her that we must have parental consent before receiving his or her personal information.

Website Registration and Website Use

When users register with the Website, each user provides a first name, email address, and zip code.. By providing LocalGetaways with your email address, you agree to receive the LocalGetaways newsletter. Users also may: (a) indirectly provide Personally-Identifying Information through their participation in interactive programs that may be offered on the Website from time to time; or (b) directly provide Personally-Identifying Information such as a name, address, city, state, zip code, email address, telephone number, and credit card number when purchasing products from the Website.

If you do not wish to disclose Personally-Identifying Information, please do not provide it to LocalGetaways. Users of the Website are under no obligation to provide LocalGetaways with Personally-Identifying Information of any kind, with the caveat that a user’s refusal to do so may prevent the user from using certain Website features.

On-line Forums and Blogs

Certain Personally-Identifying Information collected from users is disclosed as a matter of course as a result of those users’ use of the Website. There are risks involved in dealing with strangers, including people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Website. We expect that you will use caution and common sense when using the Website. Users assume all responsibility for any loss of privacy or other harm resulting from voluntary disclosure of personally identifying information.

DMCA Infringement Notifications, Notices of Violations of Website Terms of Service, and Other Communications Directed to LocalGetaways

By submitting a Copyright Infringement Notification or other communication (including communications about content stored on or transmitted through the Website) you consent to have such communication forwarded to the person or entity who stored or transmitted the content addressed by your communication, in order to facilitate a prompt resolution. For Notices of Violations of Website Terms of Service or other communications (but not DMCA Infringement Notifications), upon request LocalGetaways will edit out your name and contact information. However, DMCA Infringement Notifications (including any personally identifiable information set forth in the Notifications) will be forwarded as submitted to LocalGetaways without any deletions.

Other Disclosures

As described in the previous sections regarding Collection, use, and disclosure of Personally-Identifying Information, users may, at their option, disclose their own Personally-Identifying Information by any means they choose, including without limitation through registering with the Website and making contributions to blogs and forums on the Website. LocalGetaways will disclose Personally-Identifying Information to those LocalGetaways employees, contractors, affiliates, vendors, and suppliers who: (a) process Personally-Identifying Information on LocalGetaways’ behalf or participate with LocalGetaways in the provision or operation of the Website; and (b) agree not to use or disclose Personally-Identifying Information received from LocalGetaways other than in accordance with this Privacy Policy. LocalGetaways also will disclose Personally-Identifying information under the following circumstances:

* By Law or to Protect Rights – Local Getaways discloses Personally-Identifying Information when required to do so by law, or in response to a subpoena or court order, or when Local Getaways believes in its sole discretion that disclosure is reasonably necessary to protect the property or rights of LocalGetaways, other users, third parties, or the public at large.

* Marketing Communications – Local Getaways will email users about products and services that Local Getaways believes may be of interest to them. If a user wishes to opt-out of receiving marketing materials from Local Getaways or having their email information provided to third parties at any time after registration, they may do so by sending LocalGetaways an email at info@matthewp68.sg-host.com .

* Business Transfers; Bankruptcy – Local Getaways reserves the right to transfer all Personally-Identifying Information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or a portion of Local Getaways’ assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personally-Identifying Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and you opt-in to affirmatively accept it. Personally-Identifying Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.

Court Orders and Release of Non-Personally Identifying Information and Personally-Identifying Information

Local Getaways may disclose information collected from or about you if required to do so by court order or subpoena or if we believe that you have abused the service by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming, or otherwise to violate applicable laws.

Contests, Giveaways and Surveys

From time to time, Local Getaways may offer Website users the opportunity to participate in contests, giveaways, and other promotions. Any information submitted in connection with such activities will be treated in accordance with this Privacy Policy. From time to time, LocalGetaways may also ask Website users to participate in surveys designed to help Local Getaways improve the Website. Any Personally-Identifying Information provided to Local Getaways in connection with any survey will be used only in relation to that survey, and will be disclosed to third parties not bound by this Privacy Policy only in non-personally-identifying, aggregated form.

Email to Friends Feature and Referral Program

Local Getaways offers users the ability to send friends emails about the Website by means of the Email to Friends feature and referral program. If users choose to use the Referral Program, be assured that Local Getaways only uses friends’ email addresses on a one-time only basis to send the requested email.

Collection and Use of Information by Third Parties Generally

Third parties are under no obligation to comply with this Privacy Policy with respect to Personally-Identifying Information that users provide directly to those third parties or that those third parties collect for themselves. Local Getaways neither owns nor controls the third-party websites accessible through the Website.

Thus, this Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting a third-party, whether by means of a link on the Website or otherwise, and before providing any Personally-Identifying Information to any third party, users should inform themselves of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in those users’ discretion, protect their privacy.

Privacy Policy Changes

Local Getaways may, in its sole discretion, change this Privacy Policy from time to time. Any and all changes to Local Getaways’ Privacy Policy will also be reflected on this page. Unless LocalGetaways obtains your express consent, any revised Privacy Policy will apply only to information collected after such time as the revised Privacy Policy takes effect, and not to information collected under any earlier Privacy Policies. Local Getaways encourages visitors to frequently check this page for any changes to its Privacy Policy.

Local Getaways Mobile Application

Information Collected by the Local Getaways Mobile App

Local Getaways’ primary objective in collecting user information in the mobile app is to provide and enhance the Service and to enable users to enjoy the Service.

When you install any of the Services, Local Getaways may collect and record the information you provide to Local Getaways, whether through the Services or through social network or other third party services (“Account Information”).

CATEGORIES OF PERSONAL INFORMATION WE COLLECT

Passive Information

Passive information refers to information that is automatically collected from your device(s) when you access the App and use the Services. Local Getaways may collect passive information such as your mobile device type or geographic location. Your device typically sends passive information to our servers without your intervention whenever you visit our Apps and use the Services. For example, your device may tell the type device you are using. When you use App, the app’s server may also tell us information such as the page or link that led you to Apps and the pages you visit inside of the app.

Personal Information

Personal information means information that is specific to you and can be used to contact or identify you. By accessing the Service through a social network, mobile device or other third party platform or service or by connecting to such a third party network, platform or service via a Service, you are authorizing Local Getaways to collect, store, and use in accordance with this Privacy Policy any and all information that you agreed the social network, mobile device or other third party platform could provide to Local Getaways through the social network/mobile device/third party platform Application Programming Interface (API) based on your settings on the third party social network, mobile device or platform. Your agreement takes place when you connect with the third party network, platform or service via the Service, and/or when you connect with a Service, or “accept” or “allow” (or similar terms) a Service to access your information through a social network, mobile device or other third party platform or service. If you choose to access the Service by using your Facebook account as your login, we may receive from Facebook certain categories of personal information about you that you authorize Facebook to disclose, such as your user name, date of birth, friend list, email address and profile picture, or you may voluntarily disclose information such as your gender or your play preferences to us through your use of the Services. Any information directly collected through your Facebook account and shared with us will be imported, used and stored in a manner consistent with the Facebook Platform Policy applicable to developers in effect at the time of collection (see https://developers.facebook.com/policy/) and in compliance with any specific privacy settings set by you of which we are aware.

Use of Personal Information

Local Getaways will use personal information in the following ways:
• To fulfill your requests for our Services;
• To process and respond to your inquiries;
• To improve the Services, including diagnosis or problems with the Services;
• To help us better understand demographic characteristics of our users;
• To present content that is tailored to your interests;
• To offer you other opportunities that we think may be of interest to you. If you enter a sweepstakes, contest, or similar promotion, Local Getaways may use the information you provide to administer those programs. Your participation in online game events is conditional upon you granting Local Getaways permission to collect, use, store, transmit and display publicly statistical data, such as your scores, rankings and achievements, generated through your participation.

Email and Text Messaging Marketing

In addition, Local Getaways may use personal information to communicate with you through email regarding new products, new features, product updates, enhancements, special offers, or promotions for the application services. These communications may also include offers from Local Getaways marketing partners. Emails we send you may include a web beacon that tells us whether and at what time you have received or opened the email or clicked a link within the email. If you do not want us to use your personal information in this way, or to provide your personal information to third parties for their marketing purposes, please uncheck the appropriate box when you register or you can opt out by contacting us at connect@localgetaways.com. You can also opt out by clicking on the “unsubscribe” button on the emails or turning off the Local Getaways application push notifications in the Account Settings in the App or in the Settings on your smartphone.

Use of Passive Information

Local Getaways collects passive information for purposes of analyzing user preferences and trends in order to improve the quality and design of the Services and to create new features, promotions, and functionalities; for editorial and feedback purposes; for marketing and promotional purposes; for content improvement; and to customize the Services. This information may also be shared with advertisers and our business partners on an aggregated anonymous basis.

Deleting Your Information

If you would like Local Getaways to delete your record in its system, you may do so by navigating to the Account page within the Discover Atlanta App, scrolling down to the bottom of your Account profile and clicking “DELETE ACCOUNT.” Your personal data will be deleted both on your device and on Local Getaways servers and your Discover Atlanta App will be reset. If you have further questions about deleting your personal data or you would like to request certain data to be deleted without deleting your account, please contact Local Getaways at connect@localgetaways.com and it will accommodate your request if it is not legally obligated to retain the record. If you have granted Local Getaways access to your Account Information through a Service, you may request deletion of your Account Information by dissociating or removing the Local Getaways application from your social network or third party service account in accordance with the instructions provided by the social network or third party service.

Security

Local Getaways has made reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, or disclosure. However, Local Getaways cannot guarantee that unauthorized third parties will never be able to overcome those measures or use your personal information for improper purposes. Also please note that email and messaging systems are not considered secure, so Local Getaways discourages you from sending Local Getaways personal information through these media.

For California Consumers California “Shine The Light”

If you are a California resident, California Civil Code Section 1798.83 (“Shine-The-Light” law) permits you to request information regarding the disclosure of your personal information by us, or our subsidiaries or affiliates, to a third party for the third party’s direct marketing purposes. To make such a request, please contact us as provided below. Except as may be provided in this Privacy Policy, we do not trade, sell, lease or otherwise provide any personal information regarding our users to any third parties for their direct marketing purposes.

California Consumer Privacy Act (“CCPA”)

The California Consumer Privacy Act (CCPA) gives California consumers enhanced rights with respect to their personal information that is collected by businesses.

First, California consumers may opt out of having their personal information sold to other persons or parties.

Second, they can request to know:

What specific pieces of information a business has collected about the consumer;
Categories of personal information it has collected about the consumer;
Categories of sources from which the personal information is collected;
Categories of personal information that the business sold or disclosed for a business purpose about the consumer;
Categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
The business or commercial purpose for collecting or selling personal information.

Third, California consumers can request that a business delete personal information about the consumer that a business has collected from the consumer.

Local Getaways may be considered a covered business under the CCPA as it collects and processes the personal information of California consumers. This Privacy Policy provides the required notices to California consumers. The CCPA also prohibits covered businesses from providing discriminatory treatment to California consumers if they exercise their rights under the Act.

Local Getaways does not presently sell any personal information to third parties for any purpose. To make a “request to know” or “request to delete” your personal information, send us an e-mail at connect@localgetaways.com. Please put either “Request to Know” or “Request to Delete” in the subject heading of your email and indicate which of Local Getaways’ apps/websites pertains to your inquiry. Before responding, we must verify that the person making the request is the person about whom we have collected their personal information. Therefore, we may ask you to provide certain, limited personal information, such as your name and email address to verify and match your identity with our records and systems. If you have an account with us, we may ask that you verify your identity through our standard account authentication process. This is also to protect against fraud. We will not retain this personal information or use it for any other purpose. Also please be advised that we need to search our records and systems only for the preceding 12 months. There may be cases where we do not have any personal information about you or we are not able to verify your identity for matching purposes. Deleting your personal information may result in the closing of your account and inability to access the Services. However, you can always re-register at any time.

With respect to the data we collect about you through your use of our Services, we are the data controller.

Lawful bases.

When collecting, using, sharing, or otherwise processing data about you, we do so on the basis of your explicit consent, our need to fulfill this or a related agreement we have with you, including our Terms of Use, our or a third-party partner’s legitimate business interests, or to comply with our legal obligations, as applicable.

Cross-border transfers. 

As a California-based company, we store and use data outside the EU. To ensure adequate protection of personal data in cross-border transfer and/or processing, we use appropriate safeguards as allowed under applicable law or regulation.

Remedies. 

If you feel you haven’t received a timely or satisfactory response from us in connection to a question or complaint related to this Policy, you can raise the issue with your local supervisory authority without prejudice to any other rights you may have.
